GECELCA 3 is a mixed public utilities company, whose applicable legal regime in contractual matters is established in Law 142 of 1994. This means that its acts and contracts are governed by private law (Ruling C-736 of 2007).
By virtue of the above, the contracting regime applicable to the company is private law, and it is not subject to the state contracting regime set forth in Laws 80 of 1993 and 1150 of 2007. Therefore, it has its own Procurement Regulations, which are aligned with the principles of administrative function and fiscal management outlined in Articles 209 and 267 of the Political Constitution.
